1. Overview

Welcome to CataTrain.

These Terms of Service (“Terms”) govern your access to and use of the CataTrain website, online store, products, content and related services (collectively, the “Services”).

Throughout these Terms, “CataTrain”, “we”, “us” and “our” refer to CataTrain.

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer and sell our products.

By accessing our website, placing an order or otherwise using the Services, you agree to these Terms, together with our Privacy Policy, Refund and Returns Policy and any other policies expressly incorporated into them.

If you do not agree with these Terms, you should not use the Services.

Nothing in these Terms limits or excludes any rights that cannot lawfully be limited or excluded under applicable consumer-protection law.

2. Eligibility and customer information

You must have the legal capacity to enter into a binding contract in order to make a purchase through our store.

When placing an order, you agree to provide accurate, current and complete information, including your contact, billing and shipping information.

You are responsible for maintaining the confidentiality of any customer-account credentials and for activity carried out through your account.

If you purchase on behalf of a company, healthcare institution, university or other organisation, you confirm that you have authority to make the purchase on its behalf.

3. CataTrain products and intended use

CataTrain develops and supplies physical products designed primarily for surgical simulation, technical-skills training and education.

Unless expressly stated otherwise, CataTrain products:

are intended for simulation and training purposes only;

are not intended to be used on patients;

are not intended for diagnosis, treatment or prevention of disease;

are not a substitute for formal medical education, supervised surgical training, professional accreditation or clinical judgement; and

do not guarantee the acquisition of surgical competence or any particular clinical outcome.

Some CataTrain products are designed to be used with surgical or sharp instruments. Users are responsible for handling such instruments safely and for following all appropriate professional, institutional and safety procedures.

CataTrain products should be used only for their intended training purpose and in accordance with any instructions supplied with the product.

4. Training consumables and replaceable components

Certain CataTrain products contain components specifically designed to be cut, punctured, torn, injected into, manipulated, deformed or otherwise consumed during training.

Such components may therefore have a limited usable life and may require replacement after one or more training sessions depending on the manner and intensity of use.

Normal wear, cuts, punctures, deformation or deterioration resulting from the intended training activity do not by themselves constitute a product defect or lack of conformity.

This does not affect your statutory rights where a component was defective, incorrectly manufactured or otherwise non-conforming when supplied.

5. Product descriptions and images

We take reasonable care to ensure that product descriptions, dimensions, photographs, illustrations and other information displayed on our website are accurate.

Because our products may be manufactured using processes such as additive manufacturing, moulding or assembly of flexible components, minor cosmetic differences may occur between individual units.

Small differences in surface texture, layer appearance, colour tone or other non-functional characteristics may occur where they do not materially affect the advertised function of the product.

Screen settings may also cause colours to appear differently from the physical product.

We reserve the right to improve or make minor technical changes to our products provided that such changes do not materially reduce the functionality or quality described at the time of purchase.

6. Orders and formation of the contract

When you place an order through our store, you are making an offer to purchase the selected products.

After placing your order, you will normally receive an electronic confirmation.

We reserve the right to refuse or cancel an order before fulfilment where there is a legitimate reason to do so, including suspected fraud, payment failure, an obvious pricing or technical error, inability to fulfil the order or restrictions on delivery.

If we cancel an order after payment has been taken, the corresponding amount will be refunded.

Please review your order carefully before confirming your purchase.

Your statutory cancellation and withdrawal rights remain unaffected.

7. Prices, taxes and payment

Prices displayed in our store will be shown in the currency indicated on the website.

Applicable taxes, delivery charges and any other mandatory costs will be displayed or calculated before you confirm your purchase where required by law.

You will not be charged additional optional amounts without your express agreement.

You agree to provide valid and accurate payment information and confirm that you are authorised to use the payment method selected.

Payments may be processed by Shopify and/or third-party payment service providers.

We do not generally receive or store your complete payment-card details.

8. Shipping and delivery

Available delivery methods, estimated delivery times and applicable shipping charges will be shown during checkout where possible.

Delivery times are estimates unless we expressly agree to a specific guaranteed delivery date.

We will take reasonable steps to deliver your order within the indicated timeframe.

Where you purchase as a consumer and we arrange the carrier, the risk of loss or damage to the goods remains with CataTrain until you, or a third party designated by you other than the carrier, takes physical possession of the goods.

If you independently appoint a carrier that was not offered by us, the transfer of risk may occur at a different time as provided by applicable law.

Unless another delivery period has been agreed, consumer orders will be delivered within the period required by applicable law.

9. Returns and right of withdrawal

Returns, cancellations and refunds are governed by our Refund and Returns Policy together with applicable consumer law.

Consumers purchasing online in the European Union generally have the right to withdraw from the purchase within 14 calendar days after receiving the goods, subject to the exceptions provided by law.

Products may be inspected to determine their nature, characteristics and functioning. If a product is handled or used beyond what is reasonably necessary for that purpose and its value is reduced, the customer may be responsible for that reduction in value.

Consumable training components that have been cut, pierced, torn, injected into, materially deformed or otherwise used may therefore result in an appropriate deduction from the refund where their value has been reduced.

10. Legal guarantee and defective products

Nothing in these Terms or in our Refund and Returns Policy limits the statutory rights applicable to defective or non-conforming goods.

For products sold by CataTrain to consumers in Spain, the statutory conformity period applicable to new goods is currently three years from delivery, subject to the conditions established by applicable law.

Where a product is defective or does not conform to the contract, the customer may be entitled to remedies including repair, replacement, price reduction or termination of the contract, depending on the circumstances and applicable law.

The legal guarantee does not cover damage caused after delivery by misuse, accidental damage, improper storage, unauthorised modification, normal wear or the intentional consumption of components designed to be used during surgical training.

11. Intellectual property

The CataTrain website and its original content, including text, images, photographs, videos, graphics, logos, branding, manuals, instructional materials, product presentation and website design, are owned by or licensed to CataTrain and may be protected by applicable intellectual-property laws.

The designs and geometry of CataTrain products, training systems, components, accessories and related technical materials may also be protected by intellectual-property rights where applicable.

Purchasing a CataTrain product does not transfer ownership of any intellectual-property rights associated with its design.

Unless permitted by law or expressly authorised by CataTrain in writing, you may not reproduce, distribute, commercially exploit, reverse engineer for commercial replication, manufacture copies of, or sell reproductions of CataTrain proprietary product designs or digital materials.

Nothing in this section restricts rights granted to you by mandatory law.

Product Safety, Intended Use and Training Equipment

CataTrain products are designed exclusively for surgical simulation, education and technical-skills training. They are not intended for use on patients, for clinical diagnosis or treatment, or as a substitute for supervised surgical training, professional judgement or formal medical education.

CataTrain simulators may be used with sharp or potentially hazardous instruments. Users must handle all needles, blades, forceps, scissors, cannulas and other surgical instruments with appropriate care and in accordance with their professional training and applicable safety procedures.

Phacoemulsification of the simulated nucleus is not recommended unless expressly stated otherwise for a specific CataTrain product. The simulated nuclear material has not been designed or validated for use with phacoemulsification equipment and may behave differently from a human crystalline lens. Its use with a phacoemulsification handpiece, tip or irrigation/aspiration system may cause obstruction, contamination, abnormal resistance or damage to the equipment.

Any use of phacoemulsification equipment with CataTrain materials contrary to these instructions is carried out outside the intended use of the product. To the extent permitted by applicable law, damage to third-party equipment resulting from such use is not covered by CataTrain's product warranty. Nothing in this provision excludes or limits any liability or consumer right that cannot legally be excluded.

CataTrain products should not be modified, heated, chemically treated or used with equipment or materials for which they were not designed unless expressly indicated in the product instructions.

Instruments and accessories shown in images and videos

Photographs, videos, demonstrations and educational materials published by CataTrain may show surgical instruments, microscopes, phacoemulsification equipment, forceps, choppers, cannulas, syringes, viscoelastic delivery devices or other accessories for illustrative and demonstration purposes.

Unless expressly stated in the individual product description, these instruments and accessories are not included with the purchase of a CataTrain simulator.

The contents of each product package are limited to the components specifically identified as included on the corresponding product page or order confirmation.

Consumable training components

Certain CataTrain components are designed to be cut, punctured, torn, injected into, fractured, manipulated or otherwise permanently altered during training.

Such components are consumable and their useful life will depend on the technique, instruments and intensity of use. Damage resulting from their normal intended consumption does not constitute a manufacturing defect.

Users should replace damaged or excessively worn components where continued use could affect the safety or quality of the training exercise.

User responsibility

Users are responsible for selecting appropriate instruments and for ensuring that any third-party equipment used with CataTrain products is suitable for the intended training exercise.

Instructions, videos and demonstrations provided by CataTrain are educational materials and do not constitute clinical advice or instructions for the treatment of a patient.

12. Permitted use of the website

You may use our website only for lawful purposes.

You must not use the Services to engage in fraud or unlawful activity, interfere with website security or operation, introduce malicious software, attempt unauthorised access to systems or accounts, collect personal information unlawfully, impersonate another person or organisation, or infringe the intellectual-property or other rights of CataTrain or third parties.

We may restrict or suspend access to our online Services where reasonably necessary to protect the website, our customers or our legal rights.

13. Reviews, photographs and feedback

If you voluntarily submit a product review, suggestion, photograph, testimonial or other content to CataTrain, you confirm that you are entitled to provide that material and that it does not infringe the rights of another person.

Unless otherwise agreed, you grant CataTrain a non-exclusive, worldwide and royalty-free licence to reproduce, display and use that content for operating, improving and promoting CataTrain and its products.

Where submitted material contains personal information, its processing will also be subject to our Privacy Policy and applicable data-protection law.

We may remove content that is unlawful, abusive, misleading, infringing or otherwise inappropriate.

14. Third-party services and links

Our Services may contain links to or integrations with third-party websites or services.

CataTrain does not control third-party websites and is not responsible for their content, availability or privacy practices.

Your use of third-party services may be subject to separate terms and privacy policies.

15. Shopify

Our online store is powered by Shopify.

However, purchases made through the CataTrain store are transactions between you and CataTrain, not Shopify.

Shopify provides the technology and infrastructure used to operate the store and may provide additional payment, checkout, security and related services.

To the extent permitted by applicable law, Shopify is not responsible for the fulfilment, quality, safety or conformity of CataTrain products or for obligations arising from the sales contract between CataTrain and the customer.

Nothing in this section affects rights that you may have under applicable mandatory law.

16. Privacy

Personal information collected through the Services is processed in accordance with our Privacy Policy.

Because our store is hosted by Shopify, certain personal information may also be processed by Shopify in connection with the operation, security and provision of the e-commerce platform.

17. Product safety and user responsibility

CataTrain products are intended to provide a simulated environment for practising technical skills.

Users should follow the product instructions and use appropriate care when working with needles, blades, forceps, scissors, surgical instruments or other potentially hazardous equipment.

CataTrain is not responsible for injury or damage resulting from use that is clearly contrary to the stated purpose of the product, failure to follow provided safety instructions, unauthorised modification of the product or reckless or improper use, to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.

18. Availability of the website

We aim to keep the Services available and accurate but cannot guarantee uninterrupted or error-free access to the website.

We may temporarily suspend or modify the website for maintenance, security, technical or operational reasons.

This does not affect orders or rights already acquired under a completed sales contract.

19. Limitation of liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury where liability cannot legally be excluded, or any other liability that cannot be limited under applicable law.

Nothing in these Terms excludes or restricts mandatory consumer rights.

To the maximum extent permitted by applicable law, CataTrain will not be responsible for losses resulting from use of the products for purposes materially different from their intended training purpose, unauthorised modifications or misuse of the products.

For customers acting in the course of a business or profession, additional limitations permitted by applicable law may apply.

20. Events beyond our reasonable control

We will not be responsible for delays or failures caused by circumstances genuinely beyond our reasonable control, such as major transport disruption, natural disasters, government restrictions, widespread service outages or comparable events.

This section does not remove any mandatory rights you may have regarding delayed or failed delivery.

21. Changes to these Terms

We may update these Terms from time to time to reflect changes to our Services, products, business practices or applicable law.

The version applicable to a purchase will generally be the version in force when the order was placed.

Material changes will be communicated where required by law.

The current version of these Terms will remain available on this website.

22. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply to the maximum extent legally permitted and the remaining provisions will continue in effect.

23. No waiver

If we do not immediately exercise or enforce a right under these Terms, this does not mean that we have waived that right.

24. Governing law and disputes

These Terms and contracts concluded through the CataTrain store are governed by the laws of Spain, subject to any mandatory protections that apply to consumers under the laws of their country of residence.

If you are a consumer, nothing in these Terms deprives you of mandatory rights or jurisdictional protections granted by applicable consumer law.

Any dispute will be dealt with by the courts or dispute-resolution bodies having jurisdiction under applicable law.
